چکیده:
در این مقاله به طور مشروح و مستدل به تعریف، ضرورت و شناسایی فواید تابعیت حیوان وحشی پرداخته شده است. با شناسایی تابعیت حیوانات وحشی در فروض مهاجرت حیوانات وحشی، تجارت حیوان وحشی،تعیین دادگاه صالح، قانون صالح، تعارض قوانین کشورهای مبدأ و مقصد مهاجرت حیوانات وحشی و آبزیان، شناسایی تابعیت مؤثر حیوانات وحشی دارای تابعیت مضاعف یا سیال همگی مباحثی است که در این مقاله به طرح و تبیین آن پرداخته شده است. مهمترین خروجی و نتیجه این تحقیق که با روش توصیفی – تحلیلی انجام شده است، متن قانون پیشنهادی نهاد تابعیت حیوانات وحشی است که مشتمل بر 6 ماده و 1 تبصره است. مهمترین مواد این قانون پیشنهادی عبارتند از : 1-حقوق حمایتی و حفاظتی از حیوانات توسط دولت معین از رابطه تابعیت ناشی میشود. 2- حیوانات وحشی تحت چه شرایطی متعلق به یک کشور خاص از جمله ایران خواهند شد. 3-تابعیت نوزاد حیوانات وحشی و آبزیان تابع مادر خواهد بود و نتاج متعلق به مادر و کشور مادر است. 4-حیوان مهاجر به محض ورود به قلمرو یا سرزمین کشور مقصد تابعیت کشور مقصد را خواهد داشت. 5-در مسیر مهاجرت هرگونه تعرض و نقض حقوق حیوان مهاجر از ناحیه اشخاص، قابل پیگیری و دفاع توسط هریک از کشور مقصد و مبدأ خواهد بود. 6-در صورت عدم امکان شناسایی تابعیت مؤثر حین مهاجرت: چناچه حیوان از مرز کشور مبدأ عبور کرده باشد مورد حمایت کشور مقصد خواهد بود.

The most important output and result of this research, which has been done by descriptive-analytical method, is the text of the proposed law of the institution of citizenship of wild animals, which consists of 6 articles and 1 note. The most important articles of this proposed law are: 1. The rights of protection and protection of animals by a certain government arise from the relationship of citizenship. 2. Under what conditions will wild animals belong to a particular country, including Iran? 3. The citizenship of the infant of wild animals and aquatic animals shall be subject to the mother and the offspring shall belong to the mother and the mother country. 4. The migrating animal will have the citizenship of the destination country as soon as it enters the territory or territory of the destination country. 5. In the course of migration, any encroachment or violation of the rights of the migrating animal by individuals can be pursued and defended by any of the country of destination and origin. 6. If it is not possible to identify effective citizenship during migration: If the animal has crossed the border of the country of origin, it will be protected by the country of destination.
