چکیده:
فرضیه:مطالعه قوانین اساسی جمهوری اسلامی ایران وجمهوری عربی مص(2014 میلادی)،حاکی ازآن است که ساختارهای اساسی این دوکشوربسیار مهم واستراتژیک خاورمیانه مشابه هم میباشد.سوال:اماسوالی که مطرح می شوداین است که درساختارهای اساسی قوانین اساسی ایران ومصر چه تشابهات وتفاوت هایی وجوددارندوعلت آن کدام است؟روش:پژوهش حاضربه صورت کتابخانهای، وبابررسی قانون اساسی جمهوری اسلامی ایران وجمهوری عربی مصر،کتابها ومقالات مربوط به حقوق اساسی وحقوق اساسی تطبیقی انجام شده است.نتیجه:درقانون اساسی هردوکشورمبنای مشروعیت نظام خودرابراساس اسلام و اتکاء برآرای مردم(حاکمیت مردم)استوار نمودهاند.افزون بر این وجود تشابهاتی در رژیم سیاسی-حقوقی دوکشورمانند نظام جمهوری،یکپارچگی کشور وبسیط بودن به لحاظ تقسیمات کشوری،داشتن قوه مجریه نیمه ریاستی نیمه پارلمانی، مبنای دموکراتیک درساختار نظام و حاکمیت روح اسلام بر قانونگذاری ومسائلی از این دست،جلب توجه مینماید.مواردی این چنین موجب شده،این همانیهای بسیاری درجایگاه قدرت ومحدودهی اختیارات نهادهای سیاسی دو کشور ایجاد شود که ازنحوهی انتصاب و انتخاب، شرح وظایف ومسئولیتهای آنها قابل استنباط است.به نظرمیرسد،علت اصلی این شباهتها در ساختار-های اساسی کشور مصر و ایران، میتواندریشه درشرایط، اوضاع واحوال مشابهدوکشوردرزمان تدوین قوانین اساسی آنها داشته باشد.ازاین رومیتوان گفت، قانون اساسی مصر به طور غیرمستقیم از قانون اساسی ایران الگوپذیرفته است.این بدان معنااست که،قانون اساسی ایران مطابق میل وآرمان مدونانش، توفیق نسبی ازجهت الگودهی به کشورهای منطقه خود داشته باشد.
Supposition:The study of the constitutions of the Islamic Republic of Iran and the Arab Republic of Egypt (2014) shows that the basic structures of these two countries in Middle East are very important and they are strategically similar.Question:What are the similarities and differences in the basic structures of the Iran’s constitution and Egypt’s constitution, and what is the reason for that.Method: This study has been conducted in the form of library research, and by reviewing the constitution of the Islamic Republic of Iran and the Arab Republic of Egypt, books and articles related to constitution law and comparative constitutional law.Conclusion: Both of the countries have relied their system’s legitimacy on Islam democracy. Moreover similarities between Legal and political system of both countries including, Republic system, country integrity, simplicity of national divisions, having semi-parliamentary executive power, democratic basis of system structure, and ruling Islamic Sprit on legislation and issues of this type, attract attention in this regard. Such issues create more similarities in power position and authorities of political bodies of the two countries which can be inferred from their responsibilities, job description, and appointment and selection system.
