تمایز بخشی شرط حمایت از علامت تجاری است. با این همه تمامی نظام های حقوقی در احراز تمایز بخشی نحوه حمایت از علایم متمایز کننده و همچنین تاثیر توصیفی بودن حداقلی علامت، به شکلی که به تمایز بخشی علامت تجاری لطمه نزند، رویکرد مشترکی را اتخاذ نکرده اند، به نحوی که با کنکاش در رویه قضایی و دکترین کشور های مختلف، میتوان از تفکیک علایم به ضعیف و قوی بر حسب میزان تمایز بخشی آنان و به تبع آن حمایت حقوقی متفاوت از علایم تجاری، بسته به این که در کدام یک از دسته های فوق قرار بگیرد اشاره کرد. رای دادگاه فدرال سوییس در سال 2000 میلادی و دادگاه عدالت بنولوکس که بعد ها به کرات توسط محاکم، دکترین واداره هماهمنگ سازی بازار داخلی اتحاده اروپا لحاظ شده است بر رویه قضایی دادگاه های ایران نیز ولو به شکلی غیر مستقیم بلا اثر نبوده است و رد پای این تفکیک در آراء متاخر دادگاه های تجدید نظردر حوزه علایم تجاری مشهود است.
