چکیده:
مسئلۀ «آرای داوری ابطال شده مغایر نظم عمومی» یکی از چالش های اساسی پیش روی داوری بازرگانی بین المللی است. نظم عمومی مهمترین معیار نظارت قضایی برای داوری تجاری بین المللی است کـه در منـابع داوری های تجـاری بین المللی پیش بینی شده و رسالت اصلی آن حمایت و حراست از اصول و موازین اساسی حقوق عمومی و ارزشهای هر کشور است. لذا در این تحقیق برآنیم به واکاوی حقوقی ابطال آرای داوری به دلیل مغایرت با نظم عمومی با روش کتابخانه ای بپردازیم. در مسیر صدور حکم قضایی مبنی بر ابطال یک رای داوری برای نظم عمومی، اجرای سه مرحله کاربردی ضروری می باشد: مرحله ی اول،» تشخیص نظم عمومی»؛ مرحله ی دوم،» تبیین تعارض نظم عمومی تشخیص داده شده با ماهیت رای (ابطال) یا شناسایی و اجرای آن «؛ مرحله ی سوم، تشخیص اثر تعارض» نظم عمومی «با «رای داوری». لذا نظم عمومی، یک مفهوم استثنایی در این زمینه است که هم برای «ابطال آرای داوری» در قوانین ملی و قانون نمونۀ آنسیترال مورد توجه قرار گرفته و هم بنابر تجویز «کنوانسیون ١٩٥٨ نیویورک» مستندی است که می تواند از سوی دادگاه های محل اجرای آرای داوری به منظور «عدم شناسایی و اجرای آرای داوری بازرگانی خارجی» مورد استناد واقع شود. معیار مذکور دارای مفهومی پویا و منعطف که و هم مسائل ماهوی و هم امور شکلی را در برمی گیرد. البته تمام ملاحظات نظم عمومی کشورها در داوری های تجاری بین المللی قابل اعمال نیست و صـرفا نظـم عمـومی بین المللی کشور مربوط، ترجیحا با تفسیری مضیق، اعمال می شود. مهمترین ویژگیهای معیار نظم عمـومی عبارتنـد از: پویایی و انعطاف مفهومی، امکان ورود دادگاه به ماهیت، امکان تعرض مستقیم دادگاه به رای داوری، عـدم وجـود مهلت در استناد به این معیار.
The issue of "revoked arbitral awards contrary to public order" is one of the basic challenges facing international commercial arbitration. Public order is the most important criterion of judicial supervision for international commercial arbitration, which is foreseen in the sources of international commercial arbitration, and its main mission is to support and protect the basic principles and standards of public law and values of each country. Therefore, in this research, we intend to analyze the legality of annulment of arbitration decisions due to conflict with public order.
In the process of issuing a judicial ruling on the annulment of an arbitration award for public order, it is necessary to implement three practical stages: the first stage, "identification of public order"; The second stage, "explaining the conflict of public order recognized with the nature of the vote (cancellation) or its recognition and implementation"; The third step is to identify the conflict effect of "public order" with "arbitration opinion". Therefore, public order is an exceptional concept in this field, which is considered both for the "revocation of arbitration decisions" in national laws and the UNCITRAL model law, and according to the prescription of the "1958 New York Convention" it is a document that can be used by the courts. The place of enforcement of arbitration awards should be cited for the purpose of "non-recognition and implementation of foreign commercial arbitration awards". The mentioned standard has a dynamic and flexible concept that includes both substantive and formal issues. Of course, all the considerations of the public order of the countries cannot be applied in international commercial arbitrations, and only the international public order of the relevant country is applied, preferably with a strict interpretation. The most important features of the public order standard are: conceptual dynamism and flexibility, the possibility of the court entering into the essence, the possibility of the court directly attacking the arbitration opinion, the absence of a deadline for invoking this standard.
