چکیده:
اعمال نفوذ ناروا بهمعنای سوء استفاده از نفوذ معنوی بههدف رسیدن به قراردادهای ناعادلانه، بهمنظور حمایت از طبقه ضعیف در حقوق انگلستان، توسط دادگاههای انصاف مطرح شده و در فقه امامیه و حقوق افغانستان، بحثی تحت این عنوان صورت نگرفته است. از آنجایکه نظریه فوق برخواسته از واقعیتهای موجود در جامعه است، مصادیق آن در تمامی جوامع در حوزههای مختلف خصوصاً در حوزه قراردادها و معاملات بهوفور مشاهده میشود، بحث و سؤال اصلی این است که آیا در فقه امامیه و حقوق افغانستان تدبیری در راستای حمایت از طبقهای ضعیف که مورد ظلم و ستم قرار میگیرند اندیشیده شده است یاخیر؟ بر اساس قواعد فقهی و حقوقی از یکسو میتوان معاملات تحت تأثیر اعمال نفوذ ناروا را حرام و غیرنافذ دانسته و آن را تعدیل نمود و از سوی دیگر جلوی افراد سودجو و منفعتطلب، گرفته شود. بنابراین، پژوهش حاضر براساس نظریهی فقهای امامیه و حقوقدآنان که مبتنی بر قواعد و مبانی فقهی و حقوقی مثل اصل عدالت، قاعده لاضرر، اصل حسن نیت، کرامت انسانی، میباشد، از افراد که در معرض زیان و سوء استفادهی افراد صاحبنفوذ قرار میگیرند، حمایت کرده است، در دین اسلام هیچکس حق ندارد که از ضعف و درماندگی برادر دینی خود سوء استفاده نموده و آن را وسیلهی خواستههای نفسانی خودش قرار دهد.
