چکیده:
شرط، همانند قرارداد، مظهرحاکمیت اراده و خواست طرفین بوده که در انعقاد قرارداد نقش مستقیم، با واسطه و بسزایی دارد و بنظر بسیاری ار حقوقدانان و فقها، شرط محرک وداعی وانگیزه ایجادی هر عقد است و چه بسا در صورت عدم توافق در شرط، بسیاری از عقود به مرحله فرجام نخواهد رسید، اگرچه درنظر حقوقدانان ایرانی و انگلیسی و حتی فقهای امامیه شرط، یک اصل تبعی است زمانی که شرط مطرح میشود، قراردادی باشد و بدون وجود قرارداد طرح شرط بیمعنا خواهد بود در حاکمیت اراده طرفین بواسطه نظارت دولتها درنظامهای حقوقی، محدودیتهایی گذاشتهاند ولی این محدوینها هیج تاثیری در قدرتنمایی شروط ندارد و این اراده با درنظر گرفتن دیگر اصول از جمله اصل حسن نیت اصل انصاف و اصل نفی عسر و حرج و قائده لاضرر با دخالت قوای مقنن هر کشور در قراردادها مورد حمایت قرار گرفتند ولی از باب نظم عمومی محدودیتهایی در اجرای آن گذاشتند لذا دراین مقاله خواهیم دید که که بواسطه دخالت دولتها افراد آنقدر هم در تعیین شروط آزاد نیستند و حتی فقها بعنوان یک قائده بیان داشتند "مامن عام"الاوقدخص" یعنی هیج اصلی وجود ندارد مگر اینکه تخصیص خورده باشند، برهمین مبنامحدودیتهایی برسر راه این اصل گذاشتند که در بسیاری ازمواردآن محدویتها نه تنها باحاکمیت دولتها در تعارض نیستند بلکه با نظم عمومی و اخلاق حسنه هم تضادی ندارند، ولی دولتها بنا بر مصالح جمعی نسبت به ایجاد آن محدودیت اقدام کردهاند برهمین مبنا قلمرو شروط با در نظرگرفتن این محدودیتها درهرکشور تعیین میشود..
