چکیده:
اهمیت جبران مناسب خسارت های زیست محیطی اخیراً توجه بیشتر حقوقدانان را به خود معطوف داشته است. پیچیدگی های ماهیت خسارت های زیست محیطی و جبران آنها از طریق مبنایی مناسب می تواند از دلایل مهم اختلاف نظرهای حقوقی موجود برای جبران این زیان ها باشد. در این نوشتار با عنوان «مبانی مسئولیت مدنی دولت در قبال آلودگی های زیست محیطی»، به شیوه ی تحلیلی در پی پاسخ به این پرسش ها هستیم که آیا دولت نیز مانند سایر اشخاص تنها زمانی مسئول جبران خسارت های زیست محیطی است که بین فعل یا ترک فعل او و ورود زیان رابطه ی سببیت برقرار باشد؟ و اینکه استفاده از کدام مبنا برای جبران آلودگی های زیست محیطی توسط دولت مناسب تر است؟ از آنجا که دولت حافظ منافع عموم است و مردم نیز به موجب قوانین و مقررات مختلف حق برخورداری از محیط زیست سالم را دارند، در شرایطی جبران زیان هایی که منتسب به دولت نیست، ضروری به نظر می رسد. زمانی که آلودگی های زیست محیطی منتسب به دولت باشد، در نظر گرفتن مسئولیت محض برای دولت در جبران خسارت، موجب سهولت در دادرسی و جبران بهتر خسارت های زیست محیطی می شود.
The importance of adequate compensation for environmental damage has recently attracted the attention of lawyers. The complexities of the nature of environmental damages and their compensation through a proper basis can be important reasons for legal disputes to compensate for these damages. In this article, entitled "Fundamentals of Government Civil Liability for Environmental Pollution," we seek analytically to answer the question of whether the government, like other individuals, is only responsible for compensating for environmental damage that occurs between actions or Is there a causal relationship between leaving his action and incurring losses? And which basis is more appropriate for the government to use to compensate for environmental pollution? Since the government protects the public interest and the people have the right to a healthy environment under various laws and regulations, it seems necessary to compensate for the losses that are not attributable to the government. When environmental pollution is attributable to the government, considering the government's sole responsibility for compensation will facilitate litigation and better compensate for environmental damage.
