چکیده:
امروزه پیشرفت شگرف در فناوریهای تولیدمثل در سالیان اخیر روزنه امید برای زوجهای نابارور را نمایان ساخته است چرا که آرزوی داشتن فرزند میلی جهانی است و پدر و مادر شدن از مهمترین مراحل تحول زندگی فرد است.
یکی از پدیده های نوین پزشکی که در درمان ناباروری و نازایی استفاده می شود، استفاده از رحم جایگزین است.
قرارداد استفاده از رحم زن، قراردادی است که به موجب آن زنی موافقت می کند جنین حاصل از تخمک و اسپرم زن و شوهری را حمل نماید و پس از زایمان به آنها تحویل دهد. مطالعات نشان می دهد انتخاب رحم جایگزین آشنا نظیر بستگان، دوستان یا نزدیکان زمینۀ کاهش یا رفع مشکلات ناشی از عمل جایگزینی رحمی را فراهم می نماید. طرفین عقد را در این قرارداد از یک سو زن و شوهر نابارور و از سوی دیگر مادر پذیرنده جنین، ((مادر جانشین)) تشکیل می دهند.
مطابق اصل نسبی بودن قراردادها، آثار قرارداد مادر جانشین باید به خود متعاقدین (زن و شوهر متقاضی و مادر حامل) محدود گردد. شرط مسئولیت قراردادی آن است که میان زیان دیده و عامل زیان، قرارداد صحیحی وجود داشته و زیان به سبب نقض تعهدات قراردادی ایجاد شده باشد.
امروزه نظریات فقهای معاصر امامیه در مورد اعتبار این قرارداد متفاوت است و عده ای از فقها استفاده از رحم زن دیگر را در تولیدمثل جایز و عده ای دیگر این عمل را حرام و قرارداد را غیر معتبر می دانند.
دیدگاه حقوق دانان ایران نیز در این مورد متفاوت است، برخی حقوق دانان این قرارداد را صحیح و معتبر و برخی دیگر به علت مغایرت با نظم عمومی باطل می دانند برای صحت قرارداد رحم جایگزین صرف استناد به ماده 10 قانون مدنی (اصل حاکمیت اراده طرفین و آزادی قراردادها) و قواعد عمومی قرارداد در شرایط صحت کافی نیست. چرا که و همۀ آثار قرارداد بر اساس اراده طرفین نمی تواند تعیین شود و پاره ای آثار قهری است و مهمترین اثر، قرابت و نسب حاصل از قرارداد است.
به نظر می رسد با تصویب قوانین و تشکیل کمیته ها خاص برای بررسی موارد درمان نازایی با روش رحم جایگزین می توان از بروز عوارض و عواقب احتمالی پیشگیری کرد.

Studies show that choosing a familiar surrogate, such as relatives, friends or close ones, provides the context to reduce or eliminate the problems caused by the operation of surrogacy. In this contract, the parties form the marriage, on the one hand, the infertile husband and wife, and on the other hand, the mother who accepts the fetus, ((surrogate mother)).
According to the principle of relativity of contracts, the effects of the surrogate mother contract should be limited to the contractors themselves (husband and wife of the applicant and surrogate mother). The condition of contractual liability is that there is a valid contract between the victim and the cause of the loss and the loss is due to breach of contractual obligations.
Today, the opinions of contemporary Imamiyya jurists are different about the validity of this contract, and some jurists consider the use of another woman's womb as permissible for reproduction, while others consider this action to be haram and the contract invalid.
The views of Iranian lawyers are also different in this matter, some lawyers consider this contract to be valid and valid, while others consider it invalid due to the conflict with public order. For the validity of the womb contract, it is an alternative to refer to Article 10 of the Civil Code (principle of the sovereignty of the will of the parties and freedom of contracts) and the general rules of the contract are not sufficient in terms of correctness. Because all the effects of the contract cannot be determined based on the will of the parties, and some of them are coercive effects, and the most important effect is kinship and descent resulting from the contract.
It seems that possible complications and consequences can be prevented by passing laws and forming special committees to investigate cases of infertility treatment with surrogacy.
