چکیده:
در این پژوهش، به بررسی حمایت از حقوق کارگر به عنوان حقوق طبیعی افراد در آموزههای اسلامی در فقه و حقوق افغانستان پرداخته شده و از زاویههای گوناگونی مثل رابطه کارگر و کارفرما بر مبنای اصل تعاون، روابط بدون بهر کشی، حقوق اجتماعی مساوی، ایجاد فرصت برابر برای انتخاب شغل مناسب برای افراد، ضرر و زیانهای ناشی از کار، بیمه و تأمین سلامت کارگران، دستمزد و مزایای مناسب و... براساس آموزههای اسلامی مورد تحقیق و تبیین قرار گرفته و ضرورت نظارت و مداخله دولت در روابط کارگر و کارفرما و همچنین تاکید بر افضل بودن کرامت انسانی، به انضمام مطابقت بیشتر موادّ قانون کار افغانستان با موازین فقه و از همه مهمتر، رفع تبعیض و از بین بردن فاصله بین حقوق کارگران و کارمندان و فاصله طبقاتی زندگی آنها با سایر اقشار اجتماع از طریق ایجاد قوانین یگانه که در برگیرنده تساوی حقوق کارگران و کارمندان بوده باشد، قرار گرفته است. این حمایت از کارگر بهعنوان حقوق طبیعی افراد، در قوانین اساسی کشورها تجلی یافته، دین مترّقی اسلام، قرنها پیش از به وجود آمدن مفهوم حقوق کار، با شناخت ارزش و اهمیت این امر، حقوق کار و کارگر را به رسمیت شناخته و البته بر خلاف دیدگاه مادیگرایان که کارگر را فقط ابزار میداند، اسلام کارگر را مجاهد فی سبیل الله میداند و برای کار و تلاش او علاوه بر ارزشهای مادی، پاداش الهی نیز قائل است، مضاف براینکه در این مقاله به حمایت از حقوق کارگر در فقه و حقوق جمهوری اسلامی افغانستان در مقایسه آن با فقه امامیه و حنفیه پرداخته شده و زوایای تاریک و روشن این قضیه را واکاوی و بررسی کرده و در نهایت راه کارهای اساسی را جهت رفع تنگناها و نارساییها ارائه خواهیم داد.

They are aligned with other sections of society through the creation of unique laws that include the equal rights of workers and employees.This protection of workers as the natural rights of individuals is manifested in the constitutions of countries. The progressive religion of Islam, centuries before the concept of labor rights, recognized the value and importance of this, recognized labor rights and, of course, contrary The view of the materialists, who consider the worker as only a tool, Islam considers the worker as a mujahid for the sake of God, and for his work and efforts, in addition to material values, also gives a divine reward, in addition to supporting workers' rights in jurisprudence and Islamic Republic law. Afghanistan has been compared with Imami and Hanafi jurisprudence and we will study the dark and light angles of this issue and finally we will provide basic solutions to overcome the bottlenecks and shortcomings.
