چکیده:
زمینه و هدف: عدالت قضایی از موضوعات مهم حقوق کیفری است. هدف مقاله حاضر، بررسی جرائم علیه عدالت قضایی در حین دادرسی و صدور حکم با رویکرد تطبیقی است.
مواد و روشها: مقاله حاضر توصیفی-تحلیلی است. مواد و دادهها نیز کیفی است و از فیشبرداری در گردآوری مطالب و دادهها استفاده شده است.
ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانتداری رعایت شده است.
یافتهها: هرچند در شیوه جرمانگاری و عکسالعمل در قبال این جرائم هماهنگی نسبی وجود دارد؛ جرائم علیه عدالت قضایی در ایران برخلاف کشورهایی مانند فرانسه، بهصورت یک فصل مجزا در قانون مجازات اسلامی اشاره نشده است و صرفاً بهصورت پراکنده و در لابهلای مواد قانون مزبور مورد اشاره مقنن قرار گرفته است و این در حالی است که اساسنامه مزبور در یک فصل مجزا به جرائم علیه عدالت اشاره کرده است.
نتیجه: لازم است قانونگذار ایرانی، کم و کاستیهای قوانین جرائم علیه عدالت قضایی را با توجه به قوانین جامع جرائم علیه عدالت قضایی کشورهایی مانند فرانسه مورد بازبینی قرار دهد و قوانین اصلاحشده را در مصوبهای جدید به مرحلة اجرا در آورد.
Background and purpose: judicial justice is one of the important issues of criminal law. The purpose of this article is to examine the crimes against judicial justice during the trial and issuing the verdict with a comparative approach.Materials and methods: This article is descriptive and analytical. Materials and data are also qualitative and data collection was used in collecting materials and data.Ethical considerations: In this article, the originality of the texts, honesty and trustworthiness are respected.Findings: Although there is relative harmony in the way of criminalizing and reacting to these crimes, crimes against judicial justice in Iran, unlike countries such as France, are not mentioned in a separate chapter in the Islamic Penal Code and are only scattered among the articles of the said law. It has been mentioned by the legislator and this is while the said statute has mentioned crimes against justice in a separate chapter.Conclusion: It is necessary for the Iranian legislator to review the shortcomings of the laws of crimes against judicial justice according to the comprehensive laws of crimes against judicial justice of countries like France and implement the revised laws in the new approvals.
