چکیده:
بعد از تصویب ماده واحده سقط درمانی در مجلس شورای اسلامی (1384)، اجرای طرح غربالگری جنین با هدف شناسایی جنین مبتلا به بیماریهای مادرزادی از جمله سندرم داون آغاز گردید و اکنون اندیکاسیون مشمول سقط درمانی به 261 مورد از ناهنجاری و اختلالات جنینی افزایش یافته است و هرساله بر تعداد موارد سقط جنین پس از اعلام نتایج آزمایشات اولیه غربالگری افزوده میشود و مادران باردار زیادی به سقط جنین توصیه میشوند که بدون آگاهی به حکم شرعی آن، در مراکز سقط جنین غیرمجاز و در کمترین زمان ممکن، جنین خود را سقط میکنند. در چند سال اخیر با تجویز اکید پزشکان، اکثر مادران باردار به سوی انجام آزمایشهای غربالگری سوق داده شدهاند که به واسطه نتایج مشکوک و غیر قابلاطمینان مرحله اول غربالگری جنین بهعنوان بارداریهای پرخطر شناخته شده و اقدام به سقط جنین میکنند؛ این در حالی است که با توجه به درصد خطای قابل توجه در آزمایش غربالگری و آمار بالای مثبت کاذب این آزمایشات، جنینهای زیادی به اشتباه سقط میشوند. از سوی دیگر به جهت نتایج منفی کاذب آزمایشات غربالگری، مواردی از عدم شناسایی جنینهای مبتلا به اختلالات جنینی از جمله سندرم داون هر ساله به دنیا میآیند که نمایانگر وجود خطا در سیستم تشخیص بهداشتی درمانی این حوزه می باشد. این نوشتار درصدد است تا ضمن بررسی پزشکی موضوع غربالگری جنین، جواز شرعی سقط جنین درمانی را از ابعاد مختلف مورد تحلیل فقهی قرار دهد.
For several years, the "Fetal Screening" project has been implemented by the Ministry of Health to identify some disorders during the fetal period, especially Down's syndrome for pregnant mothers. Based on the results of these screenings, many mothers are advised to have an abortion, and these mothers are referred to abortion centers in the shortest possible time without knowing its legal ruling. Due to the deplorable state of population indicators, the country is in danger of excessive aging. A lot of abortions that are done without reason and at will is an important factor in reducing the country's population. Fetal screening tests have also become a cause and people are pushed to perform screening by the coercion and prescriptions of doctors, and a large number of these people do it because the first stage of the screening test is suspicious and labeled as high risk. They abort their own fetuses and with an undeniable error rate and high positive and false negative screening statistics, fetuses are aborted which were probably healthy. This article is written in a descriptive and analytical way using library data, and it aims to raise the ruling of the religious sanctity of pregnancy screening for the first time. Just as abortion is forbidden except in few cases, screening is also forbidden except in minor cases. Therefore, any action, encouragement and coercion in order to carry out unnecessary screening of the fetus will also be forbidden.
