چکیده:
این مقاله به بررسی اماره قانونی نسبتاً جدیدی با عنوان Unexplained Wealth Orders (UWRs) میپردازد که میتوان آن را معادل دارایی یا «ثروت غیر قابل توضیح» دانست. به موجب این فرض قانونی که در برخی کشورها از جمله انگلیس پذیرفته شده، شخص به موجب دستور دادگاه ملزم میشود درباره منشأ قانونی ثروت و داراییهای خود- که به توجه منابع مالی شناخته شده و قانونی وی هنگفت محسوب میشود- توضیح دهد؛ در غیر این صورت فرض میشود که این اموال و داراییها نامشروع است و باید استرداد شوند. مقاله به روش توصیفی- تحلیلی و با استناد به قوانین و رویه قضایی نظام حقوقی ایران و همچنین بررسی برخی روایات موجود، در جهت پذیرش و توسعه این نهاد در نظام حقوقی ایران استدلال میکند و با توجه به دادهها و یافتههای پژوهش به ویژه رویه قضایی دادگاههای ویژه اصل (49) قانون اساسی، نشان داده است پذیرش این فرض میتواند یکی از گامهای مؤثر در زمینه مبارزه جدی با فساد اقتصادی باشد.
The study examines a relatively novel legal presumption called "Unexplained Wealth Orders" (UWRs). According to this legal rebuttable presumption that is accepted in some countries, including England, a person is required by court order to explain about the legal origin of his wealth and assets- which is considered as extraordinary wealth, with regard to his/her known and legal income; otherwise, it is assumed that these properties and assets are illegal and must be restituted. The study argues for the adoption and development of this assumption in the Iranian legal system through a descriptive-analytical design, citing the laws and judicial procedures of the Iranian legal system, as well as examining some Hadiths. Findings, with regard specifically to the jurisprudence of Special Courts of Article 49 of the Iranian Constitution, suggest that accepting such assumption could be one of the effective steps in fighting financial corruption.
