چکیده:
زمینه و هدف: رویکرد حقوق بشری به توسعه، موجب آن گردید تا دولتها در بعد ملی اقدام به اتخاذ سیاستهایی به منظور تحقق اهداف حق بر توسعه و اجرای بهینه آن نمایند. در این فرآیند دولتها، ضمن بازتعریف خود در قالب حکمرانی مطلوب، باید بسترهای مشارکت آزادانه شهروندان را نیز فراهم نمایند تا توسعه اقتصادی، اجتماعی، فرهنگی و سیاسی شهروندان در سایه محدود شدن اندازه دخالت دولت و رونق حضور بخش خصوصی تحقق یابد. بر این اساس شاهد شکل گیری و رشد شرکت های دانش بنیان هستیم. بر این اساس ضمن مطالعه ماهیت شرکت های دانش بنیان به بررسی این امر می پردازیم که شرکت های دانش بنیان چه نقش و جایگاهی در تحقق خودکفایی و توسعه اقتصادی دارند؟روش: پژوهش حاضر به روش توصیفی - تحلیلی انجام شده است.یافتهها و نتایج: اسناد بین المللی متعددی از جمله میثاق حقوق مدنی و سیاسی، میثاق حقوق اقتصادی و اجتماعی و همچنین اعلامیه حق بر توسعه از دولتها می خواهند تا برای تحقق حق بر توسعه منفعل نبوده و زمینه های اجرای آن را خصوصا در عرصه اقتصاد فراهم آورند. در ایران نیز اگرچه کشور در تلاش فرآیند نیل تحلیل حقوقی و تقویت روش های اجرایی رسیدن به استقلال و خودکفایی است اما شرکتهای دانش بنیان به دلیل ضعف و ناکارایی سیاست های بالادستی در قانونگذاری و مقررات مالی و ارزی، میزان مالیات و معافیت های قانونی، کمبود امکانات و تجهیزات علمی و پیشرفته وجدید و عدم ارتباطات بین المللی تجاری علمی در جذب دانش های جدید بواسطه تحریم های اقتصادی و ممانعت از عضویت در سازمان تجارت جهانی ضعف در برنامه ریزی کلان در رسیدن به خودکفایی و ریشه های فرهنگی واجتماعی وهمچنین بی ثباتی دیپلماسی تجاری و سیاسی چندان موفق به تحقق این اصل اساسی قانون اساسی نگشته است.
Field and Aims: Context and purpose: The human rights approach to development has led governments to adopt policies in the national dimension in order to realize the goals of the right to development and its optimal implementation. In this process, governments, while redefining themselves in the form of good governance, should also provide platforms for citizens' free participation so that the economic, social, cultural and political development of citizens is realized in the shadow of limiting the size of government interference and the prosperity of the private sector. Based on this, we are witnessing the formation and growth of knowledge-based companies. Based on this, while studying the nature of knowledge-based companies, we will investigate what role and position knowledge-based companies have in realizing self-sufficiency and economic developments.
Method: The present research was carried out using a descriptive analytical method.
Finding and Conclusion: Many international documents, including the Covenant of Civil and Political Rights, the Covenant of Economic and Social Rights, as well as the Declaration of the Right to Development, require governments not to be passive in order to realize the right to development, and to establish the grounds for its implementation, especially in the economic field. to provideIn Iran, although the country is trying to achieve the process of legal analysis and strengthening executive methods to achieve independence and self-sufficiency, knowledge-based companies lack New and advanced scientific facilities and equipments and the lack of international commercial scientific communication in attracting new knowledge due to economic sanctions and preventing membership in the World Trade Organization, weakness in macro planning to achieve self-sufficiency and cultural and social roots, as well as the instability of commercial diplomacy. And the politician has not been very successful in realizing this basic principle of the constitution.
