چکیده:
زمینه و هدف: حمایت از حقوق مالکیت فکری از عوامل مهم رشد و توسعه علم و فناوری در جامعه است. در این مقاله تلاش شده به بررسی سازوکارهای حمایت کیفری از حقوق مالکیت فکری در حقوق ایران و مصر پرداخته شود.مواد و روشها: مقاله حاضر توصیفی تحلیلی بوده و از روش کتابخانهای استفادهشده است.ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانتداری رعایت شده است.یافتهها: یافتهها بر این امر دلالت دارد هم در حقوق ایران و هم در حقوق مصر مالکیت فکری مورد حمایت کیفری قرارگرفته است. البته در حقوق ایران در خصوص برخی مصادیق مالکیت صنعتی مانند اسرار تجاری نارساییهایی در زمینه تقنین وجود دارد. بهمنظور حمایت از مالکیت فکری در حقوق ایران، مجازاتهایی چون جبران خسارت، جزای نقدی، شلاق و حبس برای نقض حقوق مالکیت فکری تعیینشده است. در حقوق مصر نیز نقض حقوق مالکیت ادبی و هنری و مالکیت صنعتی با مجازاتهایی چون جریمه و حبس همراه است با این تفاوت که مجازات حبس کمتر از جزای نقدی پیشبینیشده و عمدتاً مجازاتها بهصورت جریمه است.نتیجهگیری: مجازات حبس برای نقض حقوق مالکیت فکری نهتنها باعث جبران خسارت وارده بر پدیدآورنده و صاحب اثر نمیشود که در مغایرت با حبس زدایی است. بنابراین افزایش و جایگزین شدن جزای نقدی در مجازاتهای کیفری و توسل به سازوکارهای مدنی از موضوعات مهمی است که در حمایت از حقوق مالکیت فکری نیازمند توجه قانونگذار است.
Background & Objective: The protection of intellectual property rights is one of the important factors in the growth and development of science and technology in society. In this paper, an attempt is made to investigate the mechanisms of criminal protection of intellectual property rights in Iranian and Egyptian laws.Materials & Methods: This paper is descriptive-analytical and the library method is used.Ethical considerations: In this paper, the originality of the texts, honesty, and trustworthiness have been observed.Findings: The findings indicate that both in Iranian and Egyptian laws, intellectual property is criminally protected. However, in Iranian law, there are inadequacies in the field of legislation regarding some examples of industrial property, such as trade secrets. In order to protect intellectual property in Iranian law, penalties such as compensation, fines, flogging and imprisonment have been established for the role of intellectual property. In Egyptian law, violation of literary and artistic property rights and industrial property is accompanied by punishments such as fines and imprisonment, with the difference that imprisonment is less than fines and punishments are mainly in the form of fines.Conclusion: Imprisonment for infringement of intellectual property rights not only does not compensate the creator and the owner of the work, but is contrary to removing of imprisonment. Therefore, increasing and replacing fines in criminal penalties and resorting to civil mechanisms are important issues that need the attention of the legislative in protecting intellectual property rights.
