چکیده:
هدف: یکی از سازکارهای بینالمللی حمایت از کارگران مهاجر را باید انعقاد موافقتنامههای بینالمللی تامین اجتماعی دانست. به همین جهت بسیاری از کشورها بویژه با هدف حمایت از اتباع خود که در قلمرو دولتهای دیگر بسر میبرند، به انعقاد چنین موافقتنامههایی مبادرت مینمایند. بااینحال، کشورهای درحالتوسعه، عمدتا موافقتنامههای زیادی در این زمینه با سایر کشورها ندارند. این مساله در برخی موارد موجب نادیده گرفته شدن حقوق تامین اجتماعی اتباع آنها در کشورهای خارجی یا اتباع بیگانه شاغل در قلمرو آنها میشود. باتوجهبه چالشهای موجود در این زمینه، مقاله کنونی با هدف بررسی رویکرد نظامهای حقوقی بینالمللی و داخلی (اعماز رویکرد کشورهای توسعهیافته و درحالتوسعه) به موافقتنامههای بینالمللی تامین اجتماعی، به رشته تحریر در آمده است.روش: باتوجهبه اهمیت موافقتنامههای بینالمللی تامین اجتماعی، مقاله کنونی با استفاده از روش توصیفی-تحلیلی به بررسی و تحلیل ابعاد حقوقی آن پرداخته است. یافتهها و نتیجه: یافتههای این مقاله دلالت بر آن دارد که انعقاد موافقتنامههای بینالمللی تامین اجتماعی در مورد کشورهای درحالتوسعه همچون ایران با چالشهای متعددی چون: فراهم نبودن بسترها و ظرفیتهای قانونی، اقتصادی، سیاسی و اجرایی لازم برای انعقاد موافقتنامههای تامین اجتماعی و در مورد کشورهای توسعهیافته با مشکلاتی چون عدم تمایل به انعقاد موافقتنامههای بینالمللی تامین اجتماعی با کشورهای درحالتوسعه؛ افزایش هزینههای نظام تامین اجتماعی؛ مغایرت با سیاستهای مهاجرتی و دشواری ارزیابی آثار اجرای موافقتنامههای تامین اجتماعی، مواجه است.
Concluding the international social security agreements is one of the international mechanisms to support migrant workers. For this reason, many countries today, especially with the aim of protecting their nationals who live in the territory of other governments, are trying to conclude such agreements. However, developing countries mostly do not have many agreements in this field with other countries. In some cases, this issue causes social security rights of their nationals in foreign countries or foreign nationals working in their territory to be ignored. Considering the importance of international social security agreements, the current article has investigated and analyzed its legal aspects using descriptive-analytical method.The findings of this article indicate that the conclusion of international social security agreements in developing countries such as Iran has many challenges such as: lack of legal, economic, political and executive platforms and capacities necessary for concluding social security agreements. The developed countries face with problems such as unwillingness to conclude international social security agreements with developing countries; increasing the costs of the social security system; The contradiction with immigration policies and difficulty of evaluating the effects of the implementation of social security agreements..
