چکیده:
رسالت عظیم حقوق بینالملل در غایت، استقرار نظم، صلح و امنیت جهانی است که امروزه یکی از اساسیترین نگرانیهای بشریت به شمار میرود. حقوق مالکیت فکری نیز پلی میان حقوق بینالملل و حقوق خصوصی است، خود از حمایتهای قوانین بینالمللی برخوردار است و هماکنون به جهت کاربرد بیحد و مرز آن از مهمترین مسائل عصر حاضر به شمار میرود؛ اهمیت آن زمانی بیشتر مبرهن میگردد که در عرصه بینالملل مرزهای جغرافیایی را شکسته موجبات رشد، پیشرفتهای علمی را برای کشورها به ارمغان میآورد و اثر خود را از کشوری به کشور دیگر به نمایش میگذارد. اما حقوق مالکیت فکری با چنین ابعاد گستردهای چه نقش و جایگاهی بر مهمترین غایت و مأموریت نظام حقوق بینالملل یعنی تحقق نظم، صلح و امنیت جهانی دارد؟ در این پژوهش با بررسی جایگاه حقوق مالکیت فکری در نظام حقوق بینالملل این مهم منتج گردید که حقوق مالکیت فکری در کنار آثار مثبت خود بر ایفای تعهدات بینالمللی، آثار منفی نیز بر این تعهدات داشته و در برخی از مصادیق آثار خود منجر به نقض تعهدات بینالمللی میگردد و صلح و امنیت جهانی را به خطر میافکند. تولید، اختراع، استفاده و گسترش سلاحهای کشتار جمعی توسط مالکان حقوق مالکیت فکری، اختصاص انحصاری تولید دارو، تجهیزات پزشکی، واکسن و تحریم آن برای کشورهای دیگر، نمونههایی از نقض صلح و امنیت جهانی است که متاسفانه در مقررات بینالمللی مالکیت فکری نه تنها ضمانت اجرایی برای بازدارندگی از این موارد وجود ندارد، بلکه بعضاً راه چنین اقدامات نقضی را باز گذاشته است.
