چکیده:
تحظی البحار بأهمیة خاصة لدی جل الدول، حیث تشکل أکثر من 21 بالمائة من إجمالی مساحة الکرة الأٍرضیة، فهی مصدر للثروة الغذائیة والمائیة والمعدنیة، کما أنه أغلب تدفقات السلع تتم عبر البحار فی العالم، فأصبح من الضروری الحفاظ علی أمنها وسلامتها، لذلک ازداد الاهتمام بحمایتها خاصة بعد تنامی التحدیات التی تواجه البیئة البحریة من تلوث وإرهاب ومخاطر متعاظمة.
ویعد الإرهاب من أشد الأخطار التی تهدد السلم والأمن الدولیین، حیث تم اتخاذ العدید من الإجراءات علی الصعید الدولی (ISPS) والمدونة الدولیة) SOLAS (للحد من مخاطره، والتی قد تشمل المس بتدفقات السلع والبضائع بین الدول، وتعد اتفاقیة من أهم إسهامات المنظمة البحریة الدولیة لوضع تدابیر للحفاظ علی أمن السفن والمرافق المینائیة، ویعد المغرب معنیا بتطبیق هذه الاتفاقیة حیث اتخذت العدید من الإجراءات لتفعیلها، مع العلم أنه سبق ذلک صدور الظهیر المتعلق بمراقبة الموانئ البحریة التجاریة سنة 0210 مع تعدیل مدونة التجارة البحریة للم لائمة مع آخر المستجدات.
وقد تم فی هذا البحث التعریف بمضمون هذه الاتفاقیة، والأحکام المتعلقة بتطبیقها، مع تقدیم القوانین الوطنیة فی هذا المجال والإجراءات المرتبطة بتدبیر الموانئ ببلادنا تفعیلا لالتزاماته بتطبیق هذه الاتفاقیة.
The seas are of special importance to most countries, as they constitute more than 70 percent of the total area of the
globe, as they are a source of food, water and mineral wealth, and most of the flows of goods take place across the
seas in the world. Especially after the growing challenges facing the marine environment from pollution, terrorism,
and growing dangers. Terrorism is one of the most serious threats to international peace and security, as many
measures have been taken at the international level to reduce its risks, which may include harming the flows of goods
and merchandise between countries. The SOLAS Agreement and the International Code (ISPS) are among the most
important contributions of the International Maritime Organization To put measures in place to maintain the
security of ships and port facilities, and Morocco is concerned with the implementation of this agreement, as it has
taken many measures to activate it, knowing that this was preceded by the issuance of the Dahir relating to the
control of commercial seaports in 1961 with the amendment of the Maritime Trade Code to suit the latest
developments. In this research, the content of this agreement and the provisions related to its application were
introduced, with the introduction of national laws in this field and the procedures related to the management of
ports in our country in order to activate its obligations to implement this agreement.
