چکیده:
سببیت قانونی در بستر غربی آن جلوهای نظاممند از یک دستگاه فکری ارائه میدهد. دستگاهی که به رغم تطابق با مرزبندیهای شکلی دانش امروزی و تعیین محل مناسب بحث از مفاهیم مشابه، به لحاظ محتوی از غنای لازم برخوردار نیست. از سوی دیگر جریان فکری مشابهی در میان فقهای امامیه با نکتهسنجی به بسط محتوایی بسیاری از این مفاهیم از جمله سببیت، پرداخته که البته در فقدان قالب و چارچوبهای شکلی دانش نوین به کلافی درهمتنیده میماند. تلفیق این دو بستر فکری که در مبانی دیدگاه سبب متعارف تلاقی مییابند، جلوهای غنی از لحاظ محتوی و نظاممند از حیث ساختار ارائه میدهد: در جمع سبب انسانی با سایر اسباب طبیعی یک پدیده، چنانچه نتیجه مستقیماً از رفتار عامل انسانی حادث گردد تردیدی برای انتساب نتیجه به او نیست. در زیانهای غیر مستقیم عناصر روانی به مدد حقوقدان میآید تا در یک دستگاه استدلالی، موجّه و قابل تبیین، نسبت نتایج زیانبار را با رفتار مرتکب و سایر عوامل طبیعی بسنجد. پیشبینیِ زیان آنگاه که وقوع آن محتمل است و نیز آنگاه که عملاً توسط مرتکب پیشبینی شدهاست، علمِ مرتکب به وقوع زیان، اگرچه نوعاً پیشبینی ناپذیر است، و قصدِ مرتکب در حدوث زیان به همان نحوی که رخ داده؛ اگرچه تنها بر بخت و اقبال خود چشم دوخته و رفتاری هرچند کوچک در جهت آن انجام دادهاست؛ عناصر اساسی انتساب نتایج به رفتار عامل در زنجیره سببی است که از دیدگاه سبب متعارف و مبانی مشابه آن در فقه امامیه استخراج میشود.

In indirect damages, mental elements help the jurist to measure the ratio of harmful consequences to the perpetrator's behavior and other natural factors in a reasoned, justifiable and explainable system. Predicting loss When it is probable and also when it is actually predicted by the perpetrator, the knowledge of the perpetrator of the loss, although typically unpredictable, and the intent of the perpetrator to cause the loss as it occurred; Although he has only looked at his own fortune and has acted in its direction, however small; The basic elements of attributing the results to the behavior of the agent are in the causal chain, which is extracted from the perspective of the conventional cause and similar principles in Imami jurisprudence.
