چکیده:
زمینه و هدف: پدیدة سفاهت، پیش از آنکه موضوعی فقهی یا حقوقی باشد، حالتی روانی است که
شناسایی و درک مفهومی آن در حیطة مطالعات روانشناختی است. هرچند به مسئلة رشد معاملی و
چگونگی تشخیص آن به تفصیل در منابع فقهی با مقیاس گذاری هایی پرداخته شده اما لازم است
ضمن عرضة آنها به یافته های علمی تجربی با نگاهی دوباره مورد ارزیابی قرار گیرند. پژوهش حاضر، با
نگاهی مبنایی در جهت ماهیت شناسی موضوع با بررسی مقایسهای معیارهایی که در دو حوزة فقه و
روانشناسی پیرامون سفاهت مطرح شده، صورت گرفته است.
مواد و روشها: جستار پیشرو با استفاده از روش توصیفی تحلیلی و بر پایة مطالعات میان رشته ای
صورت گرفته و دادههای آن با روش کتابخانه ای جمع آوری گردیده است. این نوشتار علاوه بر آنکه به
بیان دیدگاه های مطرح فقهی حقوقی و ارزیابی آنها در تعریف سفاهت پرداخته، سازوکارهای
روانسنجی در زمینة سفاهت را نیز مورد بررسی قرار میدهد.
نتیجه گیری: پژوهش حاضر ضمن تفکیک هوش شناختی از هوش هیجانی، این ایده را ارائه میدهد
که پدیدة سفاهت به عنوان پدیدهای روانی به کمک علائم سنجشی ناظر به هوش هیجانی قابل
شناسایی است و این ایده با برخی مقیاس های ارائه شدة فقهی نیز سازگاری دارد. کم عقلی، نداشتن
عقل معاش، رفتار غیر عقلایی و عدم بلوغ جسمی معیارهای چهارگانه ای هستند که در فقه برای
معرفی پدیدة سفاهت بیان شده است. اگرچه در تحقیقات روانشناسی، پدیدة یادشده با این عنوان
مطرح نشده ولی ضمن مباحثی چون هوش، رشد، عقب افتادگی ذهنی، هوش رفتاری، هوش شناختی
و هیجانی مورد بررسی قرار گرفته است. هرچند عناوین مزبور به عنوان شباهت های دو نگاه فقهی و
روانشناسی، زمینة مطالعة تطبیقی مقولة مورد بحث را فراهم کرده اما باید گفت معیارهای فقهی
یادشده درواقع علایم و نمادهای ابتدایی ظهور و بروز روانی پدیده سفاهت است و بدون انجام
آزمون های مکمل که در هوش هیجانی طراحی شده، نمی توان حصول رشد را به درستی تشخیص داد.
Background and Aim: Foolishness before being a jurisprudential or legal subject, is a mental state which is conceptually recognized in the psychological studies. Although transactional growth and how to identify it has been discussed in detail in jurisprudential sources with scales, but it is necessary to present them to the empirical scientific findings and re-evaluate them. The present study has been done with a basic look at the nature of the subject by comparing the criteria in the two fields of jurisprudence and psychology. Materials and Methods: The present descriptive-analytical study is based on interdisciplinary studies and its data has been collected by library method and in addition to expressing the legal and jurisprudential views and evaluating them in the definition of foolishness, also examines the psychometric mechanisms in this field. Conclusion: This study, while distinguishing cognitive intelligence from emotional intelligence, offers the idea that the foolishness as a psychological phenomenon can be identified with the help of measuring signs of emotional intelligence. This idea is compatible with some proposed jurisprudential scales. Lack of intellect, lack of subsistence intellect, irrational behavior and lack of physical maturity are the four criteria in jurisprudence to introduce the foolishness. Although in psychological researches, this phenomenon has not been discussed with this title, but it has been dealt with other concepts such as intelligence, growth, mental retardation, behavioral intelligence, cognitive and emotional intelligence. These titles, as similarities between the jurisprudenial and psychological perspectives, have provided the basis for a comparative study of the discussion, but it should be said that the above jurisprudential criteria are in fact the initial signs and symptoms of foolishness and without psychological tests in emotional intelligence, the growth cannot be accurately identified.
