چکیده:
زمینه و هدف: یکی از بارزترین نمونههای بحرانهای پدیده جنایی، جرائم اقتصادی و بانکی است که در سطح داخلی ایجاد و آثار آن در روابط خارجی نیز نمود مییابد. بنابراین بهکارگیری رویکرد سیاست جنایی در قالب فراملی در قبال جرائم سازمانیافته فراملی نهتنها بلامانع بلکه حتی میتواند عاملی موثر در پیشگیری و مبارزه با اینگونه پدیدههای مجرمانه محسوب شود. روش: این پژوهش باهدف آسیبشناسی سیاست جنایی ایران در زمینه پیشگیری از جرائم بانکی انجام گرفت و روش کار براساس مطالعات کتابخانهای بهصورت توصیفی - تحلیلی است و دادههای آن ازطریق فیشبرداری جمعآوری شد. یافتهها و نتایج: نتایج نشان داد که باتوجه به موقعیت و امکانات بانکی، وقوع جرائم بانکی و فساد مالی در این نوع سیستم بسیار محتمل بهنظر میرسد. برای شکلگیری فساد مالی، کارمندان بانک عوامل بسیار موثری هستند که از آنها میتوان به عوامل سازمانی و اداری، مقررات غیرواقعبینانه یا غیرضرور، تعاریف و استانداردهای عملیاتی مبهم در قوانین و مقررات، رویههای اداری پیچیده و بغرنج، حقوق و دستمزد پایین کارکنان دولتی، عوامل فرهنگی و اجتماعی مانند زدوبندهای میان سیاستمداران، مقامات دولتی و تجار و عوامل شناختی و گرایشی مانند سطح پایین اخلاقیات و درستی در ادارات دولتی و رواج خودگرایی، خویشاوندمداری و منطقهگرایی اشاره کرد
Background and Aim: One of the most obvious examples of crises of criminal phenomenon is economic and banking crimes that are created at the domestic level and its effects are also reflected in foreign relations. Therefore, applying the transnational criminal policy approach to transnational organized crime is not only unimpeded but can even be an effective factor in preventing and combating such criminal phenomena.Method: This study was conducted with the aim of pathology of Iran's criminal policy in the field of banking crime prevention and the method is based on descriptive-analytical studies and its data were collected through library research.Results & Conclusion: The results showed that considering the situation and banking facilities, the occurrence of banking crimes and financial corruption in this type of system seems very likely. Bank employees are very influential factors in the formation of corruption, which can include organizational and administrative factors, unrealistic or unnecessary regulations, ambiguous definitions and operational standards in laws and regulations, complex administrative procedures, low salaries of government employees, factors. Cultural and social issues such as clashes between politicians, government officials and businessmen, and cognitive and tendency factors such as low levels of ethics and correctness in government offices and the prevalence of selfishness, kinship and regionalism
