چکیده:
شهرسازی در ایران هرچند تاریخچه طولانیای دارد؛ اما رشد روزافزون جمعیت در شهرها بهویژه در قرون اخیر، پیدایش دولتها به مفهوم مدرن آن و البته نیازهای متعدد و مختلف شهروندان سبب شده است تا هرکدام از شهرها به اجرای طرحهای جامع و تفصیلی متناسب با شرایط خود رو بیاورند. در ایران تصویب و تغییر طرحهای تفصیلی شهری به عهده کمیسیونی موسوم به کمیسیون طرح تفصیلی است. این کمیسیونها در عرف با عنوان کمیسیون ماده 5 شناخته میشوند که این عنوان به ماده 5 قانون «تأسیس شورای عالی شهرسازی و معماری ایران» اشاره دارد. تنظیم و تغییر طرحهای تفصیلی نیاز به تخصص بسیاری دارد و قانونگذار نیز سعی کرده تا با گرد هم آوردن متخصصان از رشتههای متفاوت ضریب اشتباه این نهاد را تا حد ممکن پایین بیاورد. با این وجود همچنان امکان اشتباه یا تخلف عمدی اعضای این کمیسیون و نتیجتاً ورود خسارت به شهروندان وجود دارد. چالش اصلی چگونگی جبران خسارت توسط این کمیسیون است؛ اما برای رسیدن به نتیجه مطلوب باید به پرسشهایی از قبیل چیستی ماهیت این کمیسیون، وضعیت اهلیت تمتع و استیفاء آن، حدود ضمان دولت در برابر خسارات کمیسیون و نهایتاً جایگاه اعضای متخلف در این معادله پاسخ داد. از نظر نگارندگان در مرحله نخست دولت در برابر اشخاص زیاندیده، مسئول اشتباه و تخلف کمیسیون مذکور بوده و ماده 11 قانون مسئولیت مدنی به دلایل مختلف منصرف از موضوع این پژوهش است. در مرحله بعد دولت میتواند به اعضای مقصر یا متخلف حاضر در کمیسیون جهت جبران ضرر خود مراجعه نماید. اثبات و اتخاذ چنین رویکردی اعضای کمیسیون را در بررسی و تصویب صورتجلسات محتاطتر کرده و سبب جلوگیری از اشتباهات و تخلفات احتمالی خواهد شد.
Though urbanization has a long history in Iran, the ever-increasing growth of population in cities specifically in recent centuries has led to the emergence of the states in its modern sense as well as numerous different needs in citizens. This in turn has caused each one of the cities to decide to implement some comprehensive and detailed plans appropriate for their conditions. In Iran, adoption and modification of the detailed urban plans is undertaken by a commission called the Detailed Plan Commission. These commissions are known in public as the Article 5 Commission. This title refers to the Article 5 of the law of “Establishment of Iran Supreme Council of Urbanization and Architecture”.Nevertheless, there is still the possibility of mistake or intentional corruption of the members of this commission and as a result the damage suffered by the citizens. The main challange of the present commission is the mechanism of damage recompensation. But we need to answer the questions regarding the nature of this commission, condition of legal capacity and its practical implementation, the limits of the state’s liability before the damages incurred by the commission and finallay the place of the lawbreaking members. According to the authors, in the first stage, the state is responsible before the injured ones from the mistake and offence of the members of the aforementioned commission. The Article 11 of the civil liability law for different reasons is not applied to the subject of the present study. In the next stage the state can refer to the guilty members of the commission for the damage recompensation. Demonstration and adoption of such an approach have made the members of the commission more cautious in assessment and adoption of bills and it will lead to the prevention from the possible mistakes and violations.
