چکیده:
زمینه و هدف: تصمیمات مربوط به چگونگی سرمایهگذاری، تولید و مصرف افراد، خانوارها، بنگاهها و دولت بر مجموعه افرادی دیگر که مستقیما در معاملات شرکت نمیکنند نیز تاثیر میگذارد، از این رو یکی از اصلیترین موضوعات دانش اقتصاد چگونگی جبران این آسیبها و پیامدها میباشد. این مقاله ابتدا با پرداختن به مسئله ضرر در ادبیات فقهی و استخراج مدل مفهومی ضرر در فقه، به تبیین مساله پیامدهای خارجی پرداخته و سپس با اشاره به پاسخ فقهای امامیه در دستههای متفاوت و بعضا در مقابل هم در حل معضل اثرات خارجی به ارائه الگویی فقهی به عنوان نظر مختار در حل این معضل میپردازدمواد و روشها: روش تحقیق در مقاله حاضر به صورت توصیفی تحلیلی میباشد و روش جمعآوری اطلاعات بهصورت کتابخانهای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است. یافتهها: این مقاله با استخراج مدل مفهومی ضرر و زیان از فقه امامیه و تعیین جایگاه اثرات خارجی منفی به عنوان یکی از اقسام ضرر و زیان، به ارائه الگوی مختار فقهی رفع اثرات خارجی میپردازد و نهایتا با مقایسه الگوی مختار با الگوهای متعارف اقتصادی پیگوئی و کوزی در دو بخش رفع اشکالات الگوی متعارف و ویژگی متمایز کننده از مدلهای متعارف به بیان ویژگیهای متمایز کننده این الگو میپردازد. نتیجهگیری: از آنجایی که عرف مصداق اثرات جانبی را ضرر و زیان میداند لذا "قاعده لاضرر" به عنوان یک قاعده مهم فقهی در بحث اثرات خارجی قابلیت استفاده دارد و جبران ضرر و زیان و یا از بین رفتن آن را واجب میداند بدین منظور برای ارائه یک الگوی فقهی در مورد رفع اثرات خارجی، آگاهی از مدل مفهومی ضرر در فقه اهمیت بسزایی دارد چرا که علاوه بر شناخت انواع ضرر، تقریر محل نزاع اثرات جانبی در فقه به راحتی صورت میپذیرد.
