چکیده:
«کنوانسیون ایکسید» یکی از مهمترین معاهدات حقوق بینالملل اقتصادی است که افراد را بهعنوان تابعان حقوق بینالملل به رسمیت میشناسد. برخلاف کمتوجهی نسبت به سرمایهگذاری در گذشته، کشورها از اواسط دهه 1980 بهطور روزافزونی دیدگاههای مشابهی را درباره برخورد حقوقی با مسئله سرمایهگذاری خصوصی خارجی اتخاذ کردهاند. این امر را میتوان در قوانین ملّی کشورها در خصوص سرمایهگذاری، معاهدات دو یا چندجانبه بینالمللی آنها و رویکرد مثبت آنها نسبت به حلّ و فصل اینگونه دعاوی بهخوبی مشاهده کرد. این تشابهات خصوصا در زمینه آزادسازی رژیمهای سرمایهگذاری و حمایت از سرمایهگذاران قابلتوجه است. همچنین نکته جالبتوجه در این تغییرات، جایگاه خاص داوری بهعنوان وسیله انتخابی و ترجیحی حلّ و فصل دعوا از طریق ثالث است که این امر به دلیل امتیازات داوری نسبت به سایر روشهای حلّ و فصل دعوا، ازجمله «قابلیت انعطاف»، «درجه اعتماد»، «سرعت و کارآیی»، «تخصصیتر بودن»، «هزینه کم» و «محرمانه بودن» است. ایران نیز بهرغم اینکه هنوز عضو ایکسید نیست، ولی از این توسعه مستثنا نبوده است. در چند سال گذشته، تغییرات زیادی را میتوان در این زمینه در حقوق آن مشاهده کرد که برای نمونه باید از تسهیلات و تضمینات مربوط به سرمایهگذاری خارجی و اصلاحات در بسیاری از مقررات، ازجمله «قوانین داوری تجاری کشور»، «سیاستهای پولی و ارزی»، «رقابتی کردن اقتصاد» و «تلاش برای شکستن انحصارات» نام برد. یکی از راههای جذب و تشویق سرمایهگذاری در کشور، ایجاد تضمینهای حقوقی مناسب، ازجمله «امنیت کافی برای سرمایهگذاریهای خارجی» است. بدون شک، پذیرش نظام داوری ایکسید میتواند گام مثبتی برای این مهم در ایران باشد.
ICSID convention is one of the most important treaties of international economic law that recognizes individuals
as the subjects of international law. Contrary to the lack of interest in investing in the past, Since the mid-1980s,
countries have increasingly adopted similar views on legal issues with foreign investment issues. This can be
seen in national laws on investment, bilateral or multilateral international treaties, and their positive attitude
towards resolving such claims. These similarities are remarkable, especially in terms of liberalizing investment
regimes and protecting investors. An interesting point in these changes is the particular place of arbitration as the
preferred means of resolving a dispute through third parties. Arbitration points have "flexibility", "degree of
trust", "speed and efficiency", "more specialized", "low cost" and "confidentiality", Compared to other methods
of dispute resolution. Iran, despite its not yet a member of the ICSID, was not excluded from this development.
Over the past few years, there are many changes that can be made in this rights, for example, there are many
facilities and guarantees related to foreign investment and reforms in many regulations including "the rules of
commercial arbitration of the country", "monetary and currency policies", "economic competition" and "attempts
to break the monopolies". One of the ways to attract and encourage investment in the country is to create
appropriate legal guarantees, including "adequate security for foreign investments." Undoubtedly, accepting the
ICSID system can be a positive step for this important issue in Iran.
