چکیده:
قانون مجازات اسلامی مصوب 1392 سیاست کیفری نوینی را در مورد افراد کمتر از هجده سال اتخاذ کرده و مجازاتهای کمتری را نسبت به افراد بزرگسال پیشبینی کرده است. اما مهمترین ابتکار قانونگذار مربوط به درج شرط رشد و کمال عقل برای اعمال مجازاتهای حدی و قصاصی است. با این وجود ابهامات مهمی در این رویکرد قانونگذار به چشم میخورد. آنچه که در این مقاله مورد بررسی قرار گرفته، توجه به مفهوم و شرایط رشد و کمال عقل در خصوص جرایم حدی و قصاصی و انطباق آن با موازین شرعی و نظرات فقهای امامیه میباشد. همچنین در خصوص مجازاتهای اطفال و نوجوانان 9 تا 18 سال تمام شمسی بایستی گفت برای آنها در تعزیرات با فاقد رشد و کمال عقل مفروض انگاشتن، مسئولیت کیفری تدریجی مقرر شده است اما در جرایم حدی و قصاصی تنها افراد بالغ به شرط احراز شدن رشد و کمال عقل، موضوع مجازاتهای حدی و قصاصی قرار خواهند گرفت. در غیر این صورت به مانند افراد غیربالغ به مجازاتهای جایگزین محکوم خواهند شد. با این حال ابهامات فراوان و تشتت آرا قضات در این خصوص اصلاح مقررات مربوط به آن را ضروری مینماید.
