چکیده:
هدف: هدف از انجام این پژوهش، نقد اصل ضرر حاکم بر تربیت اخلاقی فایدهگرای میل بر اساس قاعدة اسلامی لاضرر بود. روش: روش پژوهش، تحلیل محتوای کیفی مضمونکاوی بوده است. یافتهها: در دیدگاه میل، بحث از وظیفة قلمرو کارایی اصل ضرر را نشان میداد. تربیت اخلاقی در این دیدگاه بسته به اینکه رفتار فرد به حقوق و آسایش دیگران زیان میزند یا نه، متفاوت بوده و مؤلفههای دخیل در این تربیت، عدالت و تدبیر بودند. بر اساس قاعدة لاضرر، دو نقد اساسی به اصل ضرر وارد است: الزامی بودن نهی ضرر مادی و غیر مادی به دیگران در هر دو حوزة تعریف و مصداق و فاقد ضمانت اجرای قوی بودن اصل ضرر در عدم زیان به خود و اصلاح دارندگان رفتارهای ناخوشایند. غفلت اصل ضرر در مورد نخست، باعث ایجاد ناسازواری در تربیت اخلاقی شده؛ به گونهای که دقیقاً مشخص نیست تربیت اخلاقی چه مفهومی دارد و فقدان دومی، منجر به عدم تحقق کامل تربیت اخلاقی یعنی به مفهومی که حقیقتاً تربیت اخلاقی نامیده میشود، میشود. نتیجهگیری: اگر چه میل، اصل ضرر را در راستای دستیابی به فایده یا اصل بیشترین خوشی تدوین کرده، اما بر اساس دو نقد مذکور میتوان گفت که این اصل نمیتواند هدف مذکور را که هدف تربیت اخلاقی نیز است، آنچنان که باید محقق سازد. لذا اصل ضرر میل نیازمند بازنگریهای جدّی بر اساس قاعدة لاضرر تشخیص داده شد تا بتواند به عنوان اصل حاکم بر تربیت اخلاقی فایدهگرا پذیرفته شود.
Objectives: The purpose of the present survey is to criticize the harm principle governing the utilitarian moral education of Mill, based on the Islamic rule of prohibition of detriment. Method: The method has been the “content-mining qualitative content analysis". Results: In Mill's viewpoint, Duty was showing the realm of the effectiveness of the principle of harm. Moral education was different depending on whether the individual's behavior is harmful to the rights and the comfort of others; the components of this education, were justice and contemplation. Two criticisms could be found upon the principle of harm: the requirement of prohibition of detriment in areas of definition and applicability; the lack of a strong performance guarantee in preventing self-harm and reforming the holders of unpleasant conducts. Neglect of the harm principle in the first leads to inappropriateness in moral education, where it is not clear what moral education means, and the lack of second, was loading to failure in full realization of moral education in its true meaning. Conclusion: Although Mill has introduced the harm principle to achieve the Utility or the greatest happiness principle, but on the basis of the mentioned critiques, it can be said that this principle cannot achieve this purpose of moral education as it should. Therefore, Mill's principle of harm requires serious revisions on the basis of the rule of prohibition of detriment, so that it can be accepted as principle governing utilitarian moral education.
