چکیده:
طی بیست تا سی سال گذشته تقاضای بیسابقهای برای مقررات قانونی جدید در زمینه حفاظت از محیط زیست وجود داشته است، که منجر به افزایش عظیمی هم در بدنه مقررات زیست محیطی و هم به تجدید نظر در ایدهها و اصول خود حفاظت از محیط زیست شده است. مقررات قانون حفاظت از محیط زیست با مقاومت بسیار زیادی از طرف مردم تصویب، تصویب و رعایت میشود. ازیکطرف، قانون محیط زیست میتواند بهعنوان یک سیستم ارزشها تعریف شود که هدف آن تشویق مردم بهعنوان مدیران طبیعت است و نهتنها کاربران آن، بنابراین مقررات مربوط به حفاظت از محیط زیست بهگونهای تفسیر میشود که ابزار اصلی محدودیت فعالیتهای مختلف است. برای جلوگیری از اختلال در سیستمهای طبیعی. از طرف دیگر، به لطف این قانون، محیط زیست طبیعت و نسلهای آینده را در مرکز مقررات زیست محیطی قرار میدهد (این دستهها معمولا شخصیت حقوقی ندارند) و نه انسانی (تنها دریافت کننده و ذینفع سیستم حقوقی سنتی). این مفهوم اساسا روابط بین طبیعت و انسان را تغییر میدهد و ابتکار عمل برای استفاده از مقررات حقوقی را تکمیل میکند. به این ترتیب، مقررات زیست محیطی وضعیت متضادی را ایجاد میکند و با توجه به حقوقی مانند حقوق مالکیت، حق زندگی شخصی و بهزیستی فرد تنش ایجاد میکند. هدف از این تحقیق آشکار ساختن منابع و مهمترین اصول مقررات حقوقی بین المللی و منطقهای در زمینه حفاظت از محیط زیست و تحلیل ماهیت قانون محیط زیست در چارچوب منافع عمومی است. قانون حمایت از محیط زیست در چارچوب حقوق بشر مانند حقوق مالکیت و حق زندگی شخصی مورد بررسی قرار میگیرد.
Over the past twenty to thirty years, there has been an unprecedented demand for new environmental regulations, which has led to a huge increase in both the body of environmental regulations and the revision of the ideas and principles of environmental protection itself. The provisions of the Environmental Protection Law are passed, approved and observed by the people with great resistance. On the one hand, environmental law can be defined as a system of values that aims to encourage people as managers of nature and not just its users, Therefore, environmental protection regulations are interpreted in such a way that the main tool is the restriction of various activities to prevent disruption of natural systems. On the other hand, thanks to this law, the environment places nature and future generations at the center of environmental regulation (these categories usually have no legal personality) and not human (only recipient and beneficiary of the traditional legal system). This concept fundamentally changes the relationship between nature and man and complements the initiative to apply legal rules. In this way, environmental regulations create the opposite situation. And it creates tension with rights such as property rights, the right to privacy and well-being. The purpose of this study is to reveal the sources and the most important principles of international and regional legal regulations in the field of environmental protection and to analyze the nature of environmental law in the context of public interest. Environmental protection law is examined in the context of human rights such as property rights and the right to privacy.
