چکیده:
حقوق ایران با توجه به ریشههای عمیق آن در فقه شیعی، مجازات سرقت حدی را در ماده 278 قانون مجازات اسلامی مصوب 1392 گنجانده است. این مجازات برای مرتبه اول، قطع انگشتان دست راست سارق است. پرسش مقاله این است که آیا قطع انگشتان دست راست سارق بهصورت مطلق و در تمامی شرایط ثابت است یا در موارد خاص این اصل تخصیص میخورد و حد قطع ید اجرا نمیشود؟ در کتب فقهی فرضی مورد بحث قرارگرفته که چنانچه سارق دست چپ نداشته باشد آیا حد قطع دست راست در مورد وی اجرا میشود یا خیر؟ مشهور فقها با استدلال به کتاب و سنت قول به قطع دست راست را در فرض ذکرشده پذیرفته و در مقابل، گروهی از فقها قول به عدم قطع را ترجیح دادهاند. در مقاله پیش رو، نگارندگان با اتکای به روش تحلیلی توصیفی و با توجه به اصول فقهی و در پی ارزیابی ادله دو گروه بر این عقیده استوارند که در فرضی که سارق فاقد دست چپ باشد نباید دست راست وی قطع شود و حد سرقت در خصوص چنین فردی قابلاجرا نیست. با توجه به اینکه در قانون مجازات اسلامی مصوب 1392 به این نکته پرداخته نشده و مقنن موضعی را نفیا یا اثباتا اتخاذ نکرده پیشنهاد اصلاح و پیشبینی این مطلب در متن قانون، مطرح گردیده است.
The Iranian law, given its deep roots in the Shiite jurisprudence, has incorporated the punishment of haddi theft in article 278 of the Islamic Penal Code of 2013. The punishment is, for the first time, amputation of the thief’s right fingers. The question of this paper is whether amputation of thief’s right fingers is an absolute ruling and must be administered in all circumstances or in specific cases, this principle is restricted and the amputation of the right hand is not administered. A hypothesis has been discussed in Islamic jurisprudential books: where the thief lacks the left hand is it permitted to administer the hadd of amputation of the right hand to him? The famous Islamic jurists, relying on the Holy Quran and Sunna have accepted the viewpoint that in such case the right hand is amputated; on the contrary, a group of Islamic jurists have preferred non-amputation. In the present paper, through an analytical-descriptive method and taking into account the Usul-al-Fiqh principles, and after evaluating the evidences of the two groups, the authors have concluded that in case the thief does not have the left hand, his right hand mustn’t be amputated and the hadd of theft is not applicable to him.
Given the fact that the Islamic penal law of 2013 has not dealt with this issue and the legislator has not adopted a positive or negative attitude, it has been recommended in this paper to amend the law and prescribe this issue therein.
