چکیده:
اگرچه رشته حقوق بینالملل قدمت چند صد ساله دارد، ولی رشته دانشگاهی روابط بینالملل نسبتاً جدید است. بعد از جنگ جهانی دول، رشتههای روابط بینالملل و حقوق بینالملل بهمیزان قابلتوجهی همپوشانی داشتند لیکن با وقوع جنگ جهانی دوم، عصر تقارب این دو رشته مطالعاتی به سر رسید. بسیاری از واقعگرایان بر این باور بودند که در دنیای فاقد اقتدار مرکزی توافقهای بینالملل نمیتوانند محدودیتهای معناداری برای رفتار دولتها ایجاد کنند. چنین گرایشاتی در چارچوب ادبیات رئالیسم ساختاری که طی آن پیامدهای بینالملل را محصول توزیع توانائیها و قدرت دولتها تلقی میکرد، تقویت میشد. در اوائل دهه 1980، لیبرالیسم بهصورت یک نظریه منسجم روابط بینالملل ظاهر شد. لیبرالیسم بر این ادعاست که پیکربندی دولت مستقل تعیینکننده رفتار آن است. پس از پایان جنگ سرد، سازهانگاری بهصورت یک رویکرد عمده نقش مهمی در پیوند این دو رشته مطالعاتی داشته است. تحت این شرایط فهم پیچیده هنجارها به درک بهتر جامعه شناختی و تاریخی حقوق بینالملل میشود. تمرکز این مقاله بر تجزیه و تحلیل پتانسیل تئوریهای روابط بینالملل بهویژه مکتب انگلیسی، رئالیسم، لیبرالیسم و سازهانگاری برای تعامل و تقارب بیشتر میان دو رشته روابط بینالملل و حقوق بینالملل است. این مطالعه حاکی است که میزان تقارب میان این دو رشته بیش از سایر حوزه های مطالعاتی است.
Although the discipline of IL is hundreds of years old , the academic field of IR is of much more recent vintage .After The first world war , the disciplines of IR and IL overlapped substantially . But with the occurrence of the World War II the era of disciplinary convergence ended .Many realists believed in an anarchical world, international agreements could not meaningfully constrain state actions. These tendencies were reinforced by a structural realist literature that viewed international outcomes as a product of the distribution of capabilities and power across states. By the early 1980s liberalism had emerged as a coherent theory of IR. Liberalism claims that the configuration of independent state determines state behavior. Since the end of the cold war, constructivism has emerged as a significant approach to bridging two fields. However its sophisticated understanding of norms makes possible a sociologically rich and historically grounded understanding of international law. The focus of this article is on the analysis potentiality of IR theories, i.e., English school, Realism, Liberalism and Constructivism for more interactions and convergence of IR and IL .Our study demonstrates the degree of convergence is greater between IL and IR than other areas.
