چکیده:
یکی از جهانشمولترین معاهدات کنوانسیون نیویورک میباشد. این کنوانسیون مشی حمایتی از آرای داوری دارد چندانکه به دادگاهها اختیار داده تا با تضییق موانع اجرا به تعداد بیشتری از آرا مجال اجرا بدهند و رویه دادگاهها در کشورهای پیشرفته نیز عموماً منطبق بر همین مشی حمایتی میباشد. عمدهترین موانع اجرا عبارت از نظم عمومی و داوری پذیری، موضوعات مرتبط با روابط خصوصی طرفین و آراء ابطالشده هستند. در این مقاله رویکرد و رویه متخذه از سوی دادگاهها در کشورهای مختلف از جمله ایران در ارتباط با این موارد مورد مطالعه قرار میگیرد. یافتهها حاکی از آن است که مراجع قضایی در کشورهای مختلف با اتکای بر قاعده انتخاب مساعدترین رژیم، که در ماده 7 کنوانسیون مقرر گردیده است، تا حد امکان دامنه عمل و اثر موانع اجرای داوری خارجی را محدود مینمایند. دامنه نظم عمومی و موضوعات داوری ناپذیر را در سطح فراملی محدودتر از سطح ملی میدانند. ایرادات مربوط به روابط خصوصی طرفین را در صورت طرح بهموقع از سوی ذینفع مؤثر قلمداد میکنند و ابطال رای در کشور مبدأ را صرفاً در صورتی مانع شناسایی برمیشمارند که جهت ابطال در کشور محل درخواست اجرا نیز موجب ابطال رای داور گردد.
New York Convention on Recognition and Enforcement of Foreign Arbitral Awards is one of the most globally accepted treaties which offers a pro-enforcement policy. Basically, the precedent echoes the pro-enforcement policy of the Convention. The Convention gives the authority to the domestic Courts to restrict the grounds of refusal aiming to enforce more arbitral awards. The refusal grounds, Under the Convention. And public policy and arbitrability; private agreements between the parties and awards annulled in the seat of the arbitration. This article aims to study the pro-enforcement policy of the Courts in various jurisdictions such as Iran. The gathered information indicates that the Courts in many countries limit the refusal grounds relying on the most favourable regime rule under article 7 of the Convention. They construe the subject of public policy and arbitrability for foreign awards in a different way from domestic ones. Moreover, they apply the private set-ups of the parties only if they have been addressed duly in the determination period. Further, they give similar effect to the awards annulled if the grounds of invalidation have the same consequence in the enforcing country.
